That is, at first nothing happens, and right after the works are finished nothing happens either, but over time \u2013\u00a0<\/span>after 5 years, for example<\/strong>\u2013 owing to rain, etc., the cracks and damage described, or tilting, etc., begin to appear in the adjoining building.<\/p>\n But<\/strong>\u00a0<\/span>let us also combine this \u00a0<\/span>with the fact that the developer of building A, which caused the damage, is now insolvent<\/strong>, or is in insolvency proceedings (formerly known as suspension of payments); or its current owners and the present homeowners’ association have no funds.<\/p>\n In short, we want to shed light on\u00a0<\/span>what should be done\u00a0<\/span><\/strong>in this apparent dead end,\u00a0<\/span><\/strong>faced by\u00a0<\/span>Building B, which has serious damage,\u00a0<\/span><\/strong>and B suspects that the damage originated\u00a0<\/span>when the adjoining building A was built or renovated, but five years have already passed and now no one seems to be responsible<\/strong>, because the developer has gone, the building contractor is no longer around either, and \u201cit is said\u201d that the damage would become time-barred after one year, and many more years than that have passed since building A was completed.<\/p>\n Well, no, that is not true: there is a way out.<\/p>\n The third party who suffers the damage<\/strong> (the owner in building B)\u00a0<\/span>may sue the architect (of building A) within the legal time limit.<\/strong>\u00a0<\/span>And that \u201clegal time limit\u201d refers\u00a0<\/span>to the time within which the defect must appear in order to be attributed to the technical professionals who took part<\/span>\u00a0<\/span>in the construction that caused the damage; it refers to the 10-year guarantee period. However, the limitation period for bringing the action (for filing the lawsuit) is \u00a0<\/span>one year<\/span><\/p>\n If the works, the basement or the micropiling that caused the damage were carried out 5, 6 or even up to 10 years ago, the architect who directed the works on building A is liable, as is the architect’s insurer.<\/strong>\u00a0<\/span>For practical purposes, it is always 10 years as well, since this concerns damage affecting the structure and foundations. There is no point thinking in terms of 1 or 3 years, because defects in finishes or lack of habitability in building A can hardly damage building B.<\/p>\n That does not mean, however, that the one-year period should not apply when calculating the limitation period for the action of the affected third parties\u00a0<\/span>\u201cfrom the moment the injured party became aware of it\u201d.<\/strong><\/p>\n To sum up, there is no doubt that the \u201clegal time limit\u201d referred to by the law\u00a0<\/span>is ten years<\/span><\/strong>, that is, Building B can claim if building A is less than 10 years old; and, from the moment the injured parties (those in building B) became aware of the damage,\u00a0<\/span>there is one year in which to file the
