Homeowners’ association awarded €412,000 in compensation for defects

The developer of the building compensates the homeowners’ association with €411,704.06, plus interest and legal costs
Dpcon, S.L. has once again obtained a favourable judgment ordering the developer of a building to pay a homeowners’ association compensation of €411,704.06.
The homeowners’ association, located in Rivas Vaciamadrid, had defects both in private elements (hairline cracks/cracks in homes, poorly fixed roller shutters, defects in the timber flooring, faults in the video entry system and extractor hoods….) and in communal areas (damp, standing water, defects in the lift shafts, faults in the building’s heating and cooling installations…). The judge ordered the developer/seller of the building to pay the homeowners’ association €411,704.06 plus interest and legal costs for the loss and damage caused. This was despite the fact that the opposing expert report did not identify those construction defects, and attributed the ones it did find to “lack of maintenance”.
