Condensation in homes. How to claim for it.

What to do about condensation in homes.
One of the most common and troublesome pathologies in properties is condensation.
This type of damp affects homes when small droplets of condensation build up on cold surfaces of the property, forming unpleasant and unsightly colonies of fungi, mould and stains, which can make the environment unhealthy.
Damp problems at home.
It can also occur in wet rooms (bathrooms, kitchens, etc.), but these rooms are prepared for it, usually tiled or with waterproof surfaces. It normally forms in the corners of walls, above skirting boards, around window frames, etc., due to what is known as the “thermal bridge” effect. This is caused by a lack of insulation in the building envelope, which, as the Technical Building Code requires, should insulate against the transmission of cold and therefore not transmit that temperature difference. However, it does not do so, and a “thermal bridge” is created, transmitting the temperature difference and causing moisture and water vapour to condense on those surfaces.
It is often seasonal, appearing periodically as the seasons change, but it is not related to a lack of ventilation. In short, poor insulation causes condensation, which undoubtedly impairs the healthiness and weathertightness of the homes.
Is this damp normal, or can you claim for it?
Homes being healthy and weathertight is a basic habitability requirement under article 3.1.c) of the Spanish Building Act (Ley de Ordenación de la Edificación, LOE).
Specifically, section c.1): Hygiene, health and environmental protection, so that acceptable conditions of healthiness and weathertightness are achieved in the indoor environment of the building.
Therefore, if a failure to meet this requirement is detected within the 3-year guarantee period established in article 17.1.b) of the LOE, a claim must be made against the parties involved in the construction who are responsible.
