DO NOT GIVE UP ON CLAIMING FOR THE CONSTRUCTION DEFECTS IN YOUR HOME OR BUILDING IF MONEY IS A PROBLEM
Owing to the current level of arrears and the lack of liquidity in homeowners’ associations, many of them face the problem of being unable to claim for the construction defects affecting their private homes or communal areas, and let their guarantees become time-barred because they cannot meet the costs (architect, lawyer and court representative). That is why Dpcon S.L. offers three options for financing a construction defects claim, subject to a prior assessment of each case.
Three payment options:
1.- Direct payment: The homeowners’ association pays the costs as they arise. That is, 50% of the expert report when instructing us on the matter and the remaining 50% on delivery of the report. Advance payments for the lawyer, the court representative and court fees are made when the lawsuit is filed with the Court, on account of the final settlement of fees, which is paid at the end of the proceedings.
2.- 6-month financing: deferred payments for both the expert report and the advance payments to the lawyer and the court representative (over 6 months, interest-free).
3.- Percentage basis: as we see that some clients find all these costs an “uphill struggle”, we offer the “percentage” option, subject to a prior assessment of each case. The client will receive 75% of the compensation or repair budget obtained and will pay neither for the expert report nor the advance payments to professionals (lawyer and court representative). Initially, only the court fee has to be paid. The rest of the amount obtained will cover our fees and those of the other professionals.
For the first two options, the advance payment received will be deducted from the fees, which will be approximately (subject to consultation) 15% for the lawyer and 6% for the court representative. With the third option, we get paid when “you get paid”.
Ask us for information with no obligation and we will study your case free of charge. After the assessment, choose the option that best suits your needs
